Terms and Conditions of Use

1. Acceptance of Terms

By accessing or using this application (the "Service"), you agree to be bound by these Terms and Conditions. The Service is operated by Amos Innovations, LLC ("we," "us," or "our"). If you do not agree to these Terms, you must not use the Service. These Terms apply to all visitors, registered users, and others who access or use the Service.

2. Beta Status

The Service is currently in beta. This means:

• features may change, be added, or be removed without notice
• the Service may contain bugs, errors, or unexpected behavior
• availability and uptime are not guaranteed
• the Service may be discontinued at any time

You should independently verify all results before relying on them for any purpose.

3. Intended Use

The Service is provided for research and informational purposes only. It is not intended for clinical, diagnostic, or medical use, and must not be used as a basis for medical decisions, patient management, or regulatory submissions.

4. No Medical or Diagnostic Advice

The outputs generated by the Service, including but not limited to Cq values, quality control metrics, and data interpretations, are provided for informational purposes only and do not constitute medical, clinical, or diagnostic advice.

5. User Accounts

Some features of the Service require you to create an account. By creating an account, you agree that:

• you will provide accurate and current information during registration
• you are responsible for maintaining the confidentiality of your password
• you are responsible for all activity that occurs under your account
• you will notify us promptly at support@qpcrguru.com if you suspect unauthorized access to your account
• you will not share your account with others or create accounts on behalf of other people without authorization

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or appear to be used for abusive purposes.

6. Acceptable Use

You agree NOT to:

• use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• attempt to reverse engineer, decompile, disassemble, or extract the source code of the Service
• scrape, crawl, or use automated tools to access the Service except as expressly permitted
• circumvent or attempt to circumvent rate limits, access controls, or other security features
• use the Service to build, train, or improve a competing product or service
• resell, sublicense, or redistribute access to the Service
• upload data containing protected health information (PHI), personally identifiable information (PII) of third parties, or other sensitive data without proper authorization
• upload content that is malicious, infringing, defamatory, or otherwise unlawful
• interfere with or disrupt the Service or its underlying infrastructure

7. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AMOS INNOVATIONS, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

Amos Innovations, LLC makes no representations or warranties regarding:

• the accuracy, reliability, or completeness of results
• the suitability of the Service for any specific purpose
• the absence of errors, interruptions, or security vulnerabilities
• data integrity or preservation

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMOS INNOVATIONS, LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM:

• use or inability to use the Service
• errors in data analysis, interpretation, or output
• decisions made based on outputs from the Service
• unauthorized access to or alteration of your data
• service interruptions, downtime, or data loss

IN NO EVENT SHALL AMOS INNOVATIONS, LLC'S TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST TWELVE (12) MONTHS, WHICHEVER IS GREATER.

9. User Responsibilities

You agree that:

• you are solely responsible for verifying all results
• you will not rely on the Service for clinical or diagnostic purposes
• you will retain your own copies of all data uploaded to or generated by the Service
• you will ensure compliance with all applicable laws and regulations in your use of the Service
• you will obtain all necessary permissions before uploading data on behalf of your institution or third parties

10. Data Handling

You retain ownership of any data you upload. The Service processes uploaded qPCR data ephemerally to generate outputs and does not retain experimental data on its servers after the analysis session ends. Account information (such as email, name, organization) is retained for as long as your account is active. For full details on data handling, please review our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Amos Innovations, LLC from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• your use or misuse of the Service
• your violation of these Terms
• your violation of any third-party rights, including intellectual property or privacy rights
• any data you upload to the Service

12. Intellectual Property

All software, algorithms, design, content, and trademarks within the Service are the property of Amos Innovations, LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service without express written permission.

13. Service Availability

Amos Innovations, LLC reserves the right to modify, suspend, or discontinue the Service (or any feature) at any time without notice. No guarantee is made regarding uptime, availability, or continuity of service.

14. Changes to Terms

These Terms may be updated from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this document. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
